Judge tosses indictment
Superior Court Judge Paul DePascale today threw out a grand jury indictment against Herbert Maisenbacher, siding with the defense that there was a lack of evidence and prosecutor misconduct. The prosecutor has 30 days to appeal, re-present or drop the case.
Maisenbacher, a former Verona resident, is accused of murdering Glen Ridge resident Joan Galligan at her home in December 2005.
